Terms and Conditions for use of the HKG Community Mobile Application (“App”) provided by the Airport Authority at the Hong Kong International Airport.


These Terms and Conditions govern your use of the Service. Please read these Terms and Conditions carefully before registering an Account. By using the Account, you agree that you have read these terms and conditions and that you accept and agree to be bound by them. 


1. Definitions


The following defined terms have the following meanings within the terms and conditions:


“AA”, "Authority", “we”, “ours” or “us” means the Airport Authority, a body corporate validly existing by virtue of the Airport Authority Ordinance Cap 483, Laws of Hong Kong.


“Account” means the HKG Community Mobile Application User Account, an account registered in accordance with these Terms and Conditions, and the relationship that is established between a User and AA’s network or online services resulting from such registration.


"Airport" or “HKIA” means the Hong Kong International Airport.


"App" means the HKG Community Mobile Application that can be downloaded through official distribution platforms for mobile smartphone devices. 


"Contents" means all information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials displayed on or available through the App.


"Service" means the App, and any other service that is offered by the Authority directly or through a third party for your use via the App.


"User" means a person who has registered an Account, and any person who has been permitted by AA to have access to and use the Account service in accordance with these Terms and Conditions.


"You" or “your” means the person(s) to whom we provide Services.


2. Acceptance


By using the Service, you agree to accept unconditionally all these Terms and Conditions as the same may be revised, amended and/or suspended from time to time by the Authority without prior notice.


3. Registration and Use of an Account


Each individual is entitled to only one Account. No corporations, trusts, partnerships or other legal entities can be enrolled as Users of the App. We reserve the right to close your Account automatically if:

  1. you are found to have more than one Account registered in your name; or
  2. as result of our investigations we believe that the Account is not being operated in accordance with these Terms and Conditions.

By registering an Account, you agree and acknowledge that you have read and agree to be bound by these Terms and Conditions. If you do not agree to any of these Terms and Conditions, please discontinue use of the Account and Services immediately. AA shall be entitled at any time to deactivate your Account if you breach any of these Terms and Conditions.


When registering an Account, you agree that:

  1. You must provide us with accurate, complete and up-to-date registration information; and
  2. You authorize us to assume that any person using the Account with your HKIARaCE Membership Account, Airport Octopus Card, mobile phone number and/or email address is yourself.
  3. You authorize us to use any personal data that you maintain in connection with your HKIARaCE Membership Account or your Airport Octopus Card to verify your identity.


You confirm that to the best of your knowledge, any material, data or information submitted by you to the App does not contain any electronic virus or other similar malicious electronic code.


Any loss incurred or sustained by the User in transmitting personal information shall be solely borne by the User. If the User is using a public device, the User shall ensure that he/she signs out from the Account once he/she has completed his/her use of the Services.


You undertake that your use of the Account does not and will not contravene any law, rule, regulation, judgment, decree, permit, authorization, policy or directive (in each case, with or without the force of law) which is binding on or otherwise applicable to you or to which it is subject.


AA has the sole discretion to refuse registration of a potential Account user and to terminate the registration of any Account user for any reason whatsoever.


4. Integrity and Security of the Account


You are responsible for safeguarding the login ID, password, digital signature and/or other Authentication Methods which may be provided to the User for accessing the Account. You shall not share these with, or transfer to any third parties and you shall immediately notify AA of any unauthorized use of the same. Under no circumstances shall AA be liable for any loss or damage whatsoever arising from your failure to comply with these requirements.


Should you come across any unauthorized use of your login details, you shall notify us immediately and effectively.


5. Charges


The Service is provided on a ‘free of charge’ basis. If any of the Service offered to you is not ‘free of charge’, we will inform you separately of the charge for that service and the relevant terms and conditions that may apply in addition to or in replacement of these Terms and Conditions. 



6. Promotion Code or Coupon


As and when a promotion campaign is launched, you may receive promotion code or coupon from us, via App, email or through other promotional channels.


Irrespective of the type of promotion code or coupon in validity at the time of your order, only one promotion code or coupon can be used per order for purchase. 


All promotion codes or coupons are non-transferable, and under no circumstances can they be converted into cash. 


There will be no residual value attached to any promotion code or coupon and no credit amount will be issued to you if the purchase amount is less than the amount of the promotion code or coupon. 


A promotion code or coupon may not be used more than once. Each promotion code or coupon has an expiry date, which will be stated at the time of the promotion or in related promotional materials, and such expiry date cannot be modified.


Some types of promotion code or coupon may be exclusive and may only be used once per customer. Once redeemed, an exclusive promotion code or coupon can no longer be applied to future purchases. If the promotion code or coupon is lost or used by someone else, no replacement promotion code or coupon will be issued.


7. Contents of the App


The Contents of the App are the Authority's property and are protected by intellectual property laws. You are not allowed to alter, modify, publish, transmit, re-distribute, participate in the transfer or sale of, create derivative works of, or in any way exploit any of the Contents, in whole or in part, without the Authority's prior approval.


8. Restriction


You are not allowed to perform illegal activities including but not limited to infringement of any person's intellectual property rights, hacking, virus distribution, cyber-attacks when using the Service. You also agree that you are solely responsible for any material of whatever nature that you transmit onto or through this App, in particular that you will not collect or store personal data about another User.


9. Disclaimers of Warranties and Liability


The Authority does not warrant that the Users can successfully use the Service. Nor does the Authority warrant that the Service will be uninterrupted, error-free, free of viruses or other harmful components. You assume full responsibility and risk for the use of the Service.


The Contents contained in the App are provided on an “as is” basis for your reference only. Whilst the Authority endeavours to ensure the accuracy of the information provided in the Contents, no statement, representation or warranty, whether express or implied, is made as to the accuracy or completeness of the Contents in the App. For the Contents that relate to third parties, users should contact the relevant organisation to verify the accuracy of the Contents.


The Authority, its directors, officers, employees or agents will not be liable for:


a. any interruption or unavailability of the Service; or


b. any errors in, omissions from, misstatements or misrepresentations (whether express or implied) concerning any information or Service delivered in the App.


This App also provides links to other websites (“Linked Websites”). Some of the contents, products, services, advertising or any other materials (collectively “Materials”) available on the App or displayed on the Linked Websites are contributed to or made available by third party service providers over whom and in respect of which the Authority has no control. The provision of the Service (when issued by third party service providers) and of Linked Websites does not constitute any endorsement by us of the Materials available or displayed on them. Access to, use of the Linked Websites and the Materials and any of your dealings with the operators of any of these Linked Websites are at your own risks.


The Authority will not accept any liability, obligation or responsibility whatsoever for any losses or damages (including but not limited to direct, indirect, incidental, exemplary, multiple, special, punitive or consequential loss or damages) howsoever arising from or in respect of the use of the App, the Service and any Materials contained in the Linked Websites or their appropriateness for use in any particular circumstances, or reliance on the information delivered through the App.


You specifically agree that we are not responsible or liable for any threatening, defamatory, obscene, offensive or illegal contents or conduct of any other party to any infringement of third party rights, including intellectual property rights.


10. Indemnity


You agree to indemnify the Authority, its directors, officers, employees and agents (collectively the “Indemnitees”) in full from and against all costs, claims, expenses, liabilities, damages and proceedings whatsoever and howsoever suffered or incurred by any of the Indemnitees arising out of or in connection with your breach of these Terms and Conditions and/or your use of the Service.


11. Privacy Policy


When you use some of the Service, we may collect your personal data. We will inform you of the purposes for which they are collected and such personal data collected will only be used for the purposes for which they were collected. For information about our treatment of your personal data, please refer to our Privacy Policy posted and available on this App.


12. General


The Authority may amend these Terms and Conditions at anytime without prior notice to you. By continuing with the use of the Service, you are deemed to have consented to any amendment or revision of these Terms and Conditions.


The Authority may prevent or terminate your access to the Service at anytime without prior notice to you if you breach any provision of these Terms and Conditions, or for any other reason at the Authority's sole discretion.


Where these Terms and Conditions are available in Traditional Chinese, the English version shall be the governing version and shall prevail whenever there is a discrepancy among the versions.


These Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. In the event of any dispute or difference arising out of or in connection with these Terms and Conditions, the User submits to the non-exclusive jurisdiction of the Courts of the Hong Kong Special Administrative Region.


In case of any dispute between the Parties in respect of or in connection with these terms and conditions, AA's determination shall be final and binding.

Privacy Policy


General


Respecting and protecting our customers’ privacy and personal data is important to the Airport Authority (“AA”“we” or “us”). This Privacy Policy will help you understand how we collect, use and safeguard your personal data in our interactions with you.


Throughout this Privacy Policy, the term "personal data" means any data relating directly or indirectly to you, from which it is practicable for your identity to be directly or indirectly ascertained, and in a form in which access to or processing of the data is practicable.


By registering an Account and using the HKG Community (“App”), you agree that we will collect, use and store your personal data in accordance with this Privacy Policy, as amended from time to time. This Privacy Policy is incorporated into and forms part of our Terms and Conditions.


We regularly review this Privacy Policy and may from time to time revise it by updating this page. By continuing to use our Services through the App after any amendments to this Privacy Policy, you are agreeing with the terms of this Privacy Policy as revised, so you are advised to visit this page periodically for updates.


This Privacy Policy applies to us and the App, but not to any third parties (including any websites maintained by our business partners). Please check and read third parties’ privacy policies before submitting any of your personal data to such third parties (whether via the App or not).


Defined terms used in this Privacy Policy shall have the same meanings as the terms defined in the Terms and Conditions of HKG Community Mobile Application.


Collection of your Personal Data When Registering an Account


You will need to enter certain personal data when registering an Account, in order to receive various news, updates, promotions that we offer to our Users.


We collect, use and store your personal data to ensure we can provide various Services to you and offer you a personal experience of the various services and facilities available at HKIA. We will keep your personal data confidential at all times and only collect, use and store it in accordance with this Privacy Policy.


When you register an Account with your Airport Octopus Card, you will be asked to provide your:


  1. Mobile phone number and/or email address (compulsory);
  2. Photo of your Airport Octopus Card – front side with your Octopus Card number (compulsory);
  3. Photo of your Airport Octopus Card – back side with your name and portrait photo (compulsory);


You can choose to register with your HKIARaCE membership, you will be asked to provide your login and password of HKIARaCE after which the above compulsory personal information will be validated and verified against the personal data you maintain in connection with your HKIARaCE membership.


The personal data is strictly necessary for us to deliver the Services. If you do not provide such information, you will not be able to complete the registration of an Account and you will not be able to enjoy the Services we provide to the Users.


If you wish to become a HKIARaCE member via the App to enroll for HKIARaCE event or enable your access to book facilities at the Airport Staff Club, you will be asked to provide additional personal data to HKIARaCE. Please refer to the HKIARaCE Privacy Policy for further details.


If the Services you use require payment of money, you will be redirected to a secure third-party website belonging to our payment gateway service provider to complete payment of any purchase. Payment-related personal data (including but not limited to the cardholder’s full name, card number prefix, cardholder’s billing address, card verification value (CVV) and the card expiry date) will be collected by the payment gateway service provider for the purpose of processing payment for your order as well as other incidental purposes. We will not be able to provide the Services to you if you do not provide the data. Please refer to the Facility Booking and HKIARaCE Privacy Policy for further details.


Separately, we may collect certain other data from you on the App:


  1. We automatically collect data relating to your online session, to gather statistical information on our server’s usage and to help us better meet your demands and expectations. This may include but is not limited to your mobile device information, including information on (i) the type of device, (ii) type and version of your browser, (iii) type and version of your operating system, (iv) your IP address, and (v) domain name. 
  2. We also use functionality that sets a unique identifier to track your use of our App across multiple devices so that your sessions are reported on our system as a single user rather than as multiple users.


You may from time to time provide us with various third parties’ personal data. You agree that you have secured the relevant third party’s consent to provide us with their personal data (to be collected, used and stored in accordance with this Privacy Policy) prior to such provision by you.


Use of Your Personal Data


We, and our service providers (including without limitation those contractors who are involved in the provision of Services), will use the personal data you provide to us for the following purposes (and any purposes directly related to these purposes) (collectively, the “Purposes”):


  1. To verify your identity as a member of the airport community and thus your eligibility to register for an Account;
  2. To provide Services to you (including assessing any application for, administration and improvement of such services);
  3. To analyse spending, consumption, trends, usage and behaviour (whether on an individualised or aggregated basis) or for the purpose of carrying surveys; and
  4. To contact you for and/or carry out direct marketing activities in connection with the shopping, dining, entertainment and service promotions at HKIA, including without limitation providing you with targeted and/or location-based advertisements, content, features, deals and offers.


In order for us to carry out any direct marketing activities, we will seek your consent (as necessary) or otherwise allow you to opt-out at the time when we collect your relevant personal data. You will be able to opt-out or unsubscribe from time to time from receiving further direct marketing communications from us on the App or by contacting us (see “Our Contact Details” section below).


Security and Protection of Your Information


We protect the personal data that you provide to us by reasonable physical, electronic and managerial measures. Please be aware that despite our efforts, no data security measures can guarantee 100% security at all times.


To protect your personal data while you are on the App, we will encrypt any personal data you transmit to us via the App.


Disclosure of Your Personal Information


Your personal data will be kept confidential and will not be disclosed to any third party except for such disclosure as allowed under the Personal Data (Privacy) Ordinance (“PDPO”) or to such third party (who may be located, and thus may store and use your personal data, outside your country of residence) as provided below:


  1. Any person or company (including third party agent or sub-contractor) who is acting for, on behalf of or jointly with us, or any of our service providers; in all such cases, disclosure may take place to fulfil any of the Purposes, provided that such third parties to whom your personal data is communicated are subject to confidentiality and privacy obligations that are materially equivalent to those set out in this Privacy Policy;
  2. Any financial institutions, charge or credit card issuing companies, credit information or reference bureaus, or collection agencies where necessary to establish and support the payment of any products and Services being requested by you; and
  3. Any other third party where such disclosure is mandated by statutory or contractual obligations or as required by law or court of law, or where such disclosure is necessary to protect our interests (as permitted by law).


Apart from the above, we do not provide your personal data to any other third parties unless your prior expressed consent is obtained. We may transfer aggregated anonymous data to third parties from time to time, which does not allow the third parties to identify you in any way.


Data Security and Retention


Subject to, or where otherwise required by law or permitted by law to protect our interests, we will:

  1. only retain your personal data for as long as it is necessary to fulfill the Purposes or to satisfy any applicable statutory obligations; and
  2. delete any of your personal data in our retention, or in the event that such personal data is in the retention of a third party procure the same to be deleted by such third party, as soon as reasonably practicable upon receiving your request for the same.


Your Right of Access and Correction of Personal Data


  1. You have the right to access, verify or update any of your personal data that we hold. You can do so by logging in to your Account. Alternatively, you may request access from the AA and also request the AA to correct the personal data that you have accessed if such data is inaccurate. An access request form can be downloaded from the website of the Office of the Privacy Commissioner for Personal Data, Hong Kong. We will handle your request as soon as possible.  Please note that under PDPO, the AA has the right to charge a reasonable fee for complying with a data access request. Data access and correction requests can be addressed to our General Personal Data Officer (see “Our Contact Details” section below).


Services Provided by Third Parties


Social media features may be hosted by a third party on our App. If a feature is provided by a third party, the use of your personal data will be governed by the privacy policy of that third party. Please review these third party privacy policies.


We may also provide links to third-party websites or systems on our website or the App. Such third-party websites or systems will have their own privacy policies that are not covered by this Privacy Policy and which you will need to consider and review.

Personal Information Collection Statement


Defined terms used in this Personal Information Collection Statement shall have the same meanings as the terms defined in the Terms and Conditions of for use of the HKG Community Mobile Application.


Collection of Personal Data 

1. When you use our Services and when you register an Account, you will be asked to provide personal data to us.

2. Personal data provided will be used for the Purposes stated in our Privacy Policy.


3. Provision of personal data is voluntary. However, if you do not provide sufficient information (i.e. information fields marked with an asterisk – “*”), you will not be able to successfully register an Account and we may not be able to provide Services to you or respond to your queries. 


Transfer of Personal Data

4. Personal data provided in this form may be transferred / disclosed to other third parties. Please refer to our Privacy Policy for further details.


Direct Marketing

5. We wish to be able to use the personal data provided to inform you of the shopping, dining, entertainment and other promotions at Hong Kong International Airport, but we cannot do so without your consent. If you consent, we will inform you of the promotions and updates available at HKIA.


6. In addition, as we continue to enhance our Services, new features and/or services will be added to our Services from time to time. There may be occasions where we will need to provide your personal data to our business partners (ie retailers or service providers operating at HKIA or those who provide services to passengers of HKIA) in order to deliver the Services. You will be informed of what personal data we will provide to our business partners.


7. We do not provide your personal data to our business partners for gain. In addition, you can be assured that we will not, without your consent, transfer your personal data to our business partners for their use in direct marketing activities.


Retention, Access and Correction of Personal Data

8. Please refer to our Privacy Policy for details regarding our retention of your personal data, or how you may check and update your information, including opting-out of receiving our direct marketing communications.
